Congressional Democrats are attempting to chill 2nd Amendment rights with the introduction of legislation that would hold firearm makers responsible if their products are used to commit crimes.
The Equal Access to Justice for Victims of Gun Violence Act would allow victims of gun crimes to sue gun manufacturers and dealers for damages, rolling back long-standing federal protections against such lawsuits via the Protection of Lawful Commerce in Arms Act.
“This is not a bill that says, ‘Merely because you sell a gun that’s later used in a crime, that you’re somehow responsible or liable,’ ” Rep. Adam Schiff (D-Calif.), who is sponsoring a House version of the bill, told The Hill.
“No, what this bill says is that the gun industry shouldn’t enjoy an immunity that no other industry enjoys for when it acts negligently, when it acts knowingly, when it acts in bad faith,” he continued.
The bill would also hold gun manufacturers liable if their products are sold to straw purchasers.
“If they’re no longer immune, they’ll be more careful who they sell to,” Schiff said.
Proponents of the legislation say it is no different than laws designed to protect consumers from faulty airbags in cars or dangerous products in the home.
“If you’re a carmaker and your airbags kill someone, you’re potentially liable,” Schiff said. “If you’re a pharmaceutical company and sell faulty drugs, you can be held liable. If you’re a liquor store and sell alcohol to minors, you can be held liable.”
Sen. Richard Blumenthal (D-Conn.), who is sponsoring a version of the bill in the upper congressional chamber, offered this: “In some jurisdictions, if your dog bites me, you are strictly liable. No excuses, it’s your fault, you pay.”
What they fail to understand (or simply willingly ignore) is that guns are inanimate objects incapable of killing or causing bodily harm without the action or negligence of the end user.
Based on the lawmakers’ examples, the logic behind their bill would dictate that: The victim of a hit and run should be able to sue the manufacturer of the car involved in the crime. Drug companies should be sued when medications are stolen and sold on the streets. The families of alcoholics should sue liquor manufacturers. And dog breeders should be sued if a puppy they sell bites a person in the future.
In other words, the anti-2nd Amendment crowd is getting extremely desperate.
