Planned Parenthood got burned – and badly – by investigators with undercover cameras who met with its executives and recorded them talking about how much they wanted to be paid for unborn baby body parts. One of them talked openly about raising her pay because she wanted an exotic $200,000 sports car.
The result has been a number of court cases, multiple investigations in Congress, and a still-uncertain final fallout from the revelations, confirmed already in Congress, that Planned Parenthood was making a profit from its trade, in apparent violation of federal law.
So the abortion business now is lashing back, working with lawmakers in California to censor any revelations obtained from “confidential disclosures” with “a health care provider, as defined.”
The bill, AB 1671, would “make it a crime for a person who unlawfully eavesdrops upon or records a confidential communication as described above with a health care provider, as defined, to intentionally disclose or distribute the contents of the confidential communication.”
The fine could be up to $10,000 and that could be accompanied by up to a year in jail. AB1671 has passed the appropriations committee and appears to be headed to the assembly floor for a vote.
Officials with Life Legal Defense Foundation, which is a nonprofit organization “committed to giving helpless and innocent human beings of any age, and their advocates, a trained and committed voice in the courtrooms,” called it a “direct attack” on the work of David Daleiden, who through his Center for Medical Progress, set up a fake company and sent investigators with concealed video cameras to Planned Parenthood clinics.
In the videos released throughout 2015, Planned Parenthood doctors and managers were caught haggling over the price of baby body parts. A number of them talked about being paid per item, how they could adjust abortion procedures to salvage requested body parts and how they could create a revenue stream from such transactions.
LLDF noted that since the release of Daleiden’s videos, 11 states have voted to defund the nation’s largest abortion industry player.
But, “California legislators are willing to trample on the right to free speech to protect Planned Parenthood’s financial interests,” said Alexandra Snyder, the executive director of LLDF. “AB 1671 violates the First Amendment rights of all Californians and we urge legislators to oppose this unconstitutional bill.”
The organization attributed the sponsorship of the bill to Planned Parenthood even though several state lawmakers actually have signed onto it.
The group said its changes would “criminalize the publication of evidence of its business practices, which include harvesting and selling the body parts of aborted babies.”
“Assembly Bill 1671 would make it a crime to publish confidential conversations with health care providers – even if those conversations disclose criminal activity. Moreover, the bill includes volunteers and independent contractors of abortion clinics as ‘health care providers.’ This means anyone who posts a photo or video of an interaction with an abortion clinic employee or volunteer – including clinic escorts – could be prosecuted under the bill. AB 1671 provides for penalties of up to $10,000 per violation and one year in state prison,” the group said.
LLDF reported, “Legislative analysts expressed concern that the bill would violate the First Amendment, which ‘gives the free press the protection it must have to fulfill its essential role in democracy.’ The U.S. Supreme Court has held that ‘prior restraints on speech and publication are the most serious and least tolerable infringement on First Amendment rights.’”
And the report pointed out that the original bill, which didn’t single out health care providers, “drew opposition from the California Newspaper Publishers Association and animal rights activists.”
But after it was amended to more specifically target anti-abortion investigative activities, “these groups withdrew their opposition. Neither the ACLU nor any other civil liberties or journalism organization has voiced opposition” to the plan as now proposed.”
The proposal also specifies that information, including any “evidence” obtained, cannot be used “in any judicial, administrative, legislative, or other proceedings.”
It also passed the public safety committees, like appropriates dominated by Democrats.
Planned Parenthood has responded in a number of ways since it was exposed by the videos – about a dozen released throughout 2015.
WND reported only earlier this week that an affidavit in one of the court cases over the investigation into the for-profit sale of baby body parts revealed a Texas prosecutor shared confidential details with Planned Parenthood during an investigation there.
“The recent filings by the Harris County district attorney confirm that the DA shared confidential documents and information with abortion provider Planned Parenthood, colluding with it in the prosecution of David Daleiden,” said Daleiden’s attorney, Thomas More Society special counsel Peter Breen.
“These filings also include evidence that appears to show that the DA’s office worked with Planned Parenthood Gulf Coast to undermine the Texas attorney general’s independent investigation of that abortion provider. The conduct of Harris County prosecutors in this case is outrageous and illegal. We look forward to pressing our motion to quash this indictment in court.”
WND had reported the suspicion that the office of District Attorney Devon Anderson in Harris County, Texas, was misbehaving.
The charge arose after Daleiden and an associate were indicted by a grand jury assembled by Anderson on counts relating to using an allegedly fake driver’s license, even though the grand jury had been tasked with investigating Planned Parenthood’s possibly illegal body-parts sales.
At the time, the pro-life organization Operation Rescue called for a new “untainted” grand jury.
Anderson’s grand jury indicted Daleiden and Sandra Merritt allegedly tampering with a governmental record, a felony that carries a punishment of up to 20 years. Daleiden also was indicted with a misdemeanor for the alleged purchase and sale of human organs.
Operation Rescue said at the time the charges against Daleiden and Merritt should be dropped or a special prosecutor “in no way affiliated with Devon Anderson, the Harris County district attorney’s office or Chip Lewis” needs to be appointed.
OR reported its information “indicates the grand jury indictments against David Daleiden and Sandra Merritt were likely in retaliation against Operation Rescue for filing a complaint against Houston abortionist Douglas Karpen, which led to a grand investigation of him in 2013.”
An Associated Press report noted that Planned Parenthood attorney Josh Schaffer said the grand jury “never even voted on possible” charges against Planned Parenthood.
“No vote means no investigation,” Cheryl Sullenger, senior vice president of Operation Rescue, said at the time. “The people are entitled to an unbiased investigation into the serious allegations of illegal conduct by Planned Parenthood. That does not appear to have happened.”
OR explained it filed a 2013 complaint that resulted in a grand-jury investigation of Karpen, who was accused by former co-workers of murdering babies born alive during shoddy abortions.
“Chip Lewis, Karpen’s attorney, falsely accused Operation Rescue of paying three former Karpen employees to testify against him and of ‘doctoring’ grisly photographs of babies Karpen had allegedly murdered, according to witnesses,” OR said.
“Lewis threatened Operation Rescue after no true bill was returned against Karpen. Lewis told the Houston Chronicle, ‘Those responsible for bringing these wholly unfounded allegations against Dr. Karpen will be held responsible for their crimes.’ He further threatened an investigation of Operation Rescue, which never materialized.”
It is Lewis, OR reported, who “has tight connections to District Attorney Devon Anderson.”
“He is a long time personal friend of hers and her now deceased husband, former D.A. Mike Anderson, and is the largest political donor to the Anderson family. It could be assumed that Anderson owes Lewis for his friendship and political favors.”
Anderson’s office filed an opposition to a motion to quash the indictments against Daleiden and Merritt, and in newly released documents, Schaffer, the abortion lawyer, admitted consulting with prosecutors about the information regarding Daleiden’s videos.
“Planned Parenthood Gulf Coast attorney Josh Schaffer admitted in a sworn declaration that the DA’s office shared materials and information with Planned Parenthood, even after the Texas attorney general’s office had forbidden them from doing so,” Daleiden’s attorney explained. “The declaration was included as part of the DA office’s response to David Daleiden’s motion to quash the indictment against him, alleging prosecutorial misconduct.
“Under oath, Schaffer admitted that he and Assistant District Attorney Sunni Mitchell attempted to do an end-run around the Texas attorney general’s directive to Mitchell to not share raw video footage with Planned Parenthood,” the lawyers explained.
Schaffer said, “I was told that the attorney general’s office agreed to give it (the video) to the Harris County district attorney’s office on the condition that they not give it to Planned Parenthood. Mitchell told me that she would try to obtain the footage by other means.”
The legal team explained Mitchell in 2013 “was responsible for a grand jury that refused to indict Houston’s late-term abortionist Douglas Karpen.”
“This was despite photographs and eyewitness testimony that implicated Karpen in illegal late-term abortions and homicide of born-alive infants, similar to Philadelphia’s notoriously convicted Kermit Gosnell.”
Anderson’s office declined to respond to a WND request for comment.
LifeNews reported Anderson’s campaign got more than $25,000 from the lawyer who works for abortion interests. Also, Planned Parenthood has donated $81,000 to Harris.
In the first undercover video released by CMP, Deborah Nucatola of Planned Parenthood commented on crushing babies.
“We’ve been very good at getting heart, lung, liver, because we know that, so I’m not gonna crush that part, I’m gonna basically crush below, I’m gonna crush above, and I’m gonna see if I can get it all intact,” she said.
