New wrinkle in Planned Parenthood’s baby body-parts case

A special prosecutor should be appointed to look into Planned Parenthood’s baby body-parts trade in Texas and another case that alleged murder against an abortionist, because the local district attorney’s office is corrupted by its links to the abortion industry, a pro-life group contends.

“We believe that the grand juries under [Harris County District Attorney Devon] Anderson’s authority were tainted beyond redemption by a personal and political agenda to cover up crimes of abortion providers,” said Troy Newman, the president of Operation Rescue.

“The serious accusations against Planned Parenthood of Gulf Coast and against Houston abortionist Douglas Karpen deserve an impartial investigation that is not infected by the bias of personal relationships or political agendas,” he said.

There was no immediate comment available about the process through which a special prosecutor would be named.

WND reported earlier when prosecutors had to dismiss counts they had brought against two undercover video investigators who caught Planned Parenthood officials nationwide negotiating for higher prices for baby body parts, including one who said she wants a Lamborghini.

The charges had been brought against Center for Medical Progress Founder David Daleiden and his co-worker, Sandra Merritt.

When the Texas grand jury was told to investigate Planned Parenthood’s operations there, which were revealed in one of the CMP videos, the members, supervised by the Harris County prosecutor’s office, instead indicted the investigators.

“They never should have indicted them. They didn’t do anything wrong,” said Mathew Staver of Liberty Counsel, which represented Merritt. “There was no criminal activity or criminal intent in this case. There is, I think, a real target that they ought to go after. That’s Planned Parenthood.”

Staver identified possible legal malpractice, noting that one of the top lawyers in the DA’s office sits on the board of the local Planned Parenthood and that the prosecutors apparently coordinated information with Planned Parenthood.

WND reported talk radio host Rush Limbaugh summarized the Planned Parenthood dispute as a “rogue” prosecutor working with a “pro-abortion” staffer inside his own office.

“So all that has to happen is that your rogue prosecutor, working in concert with your pro-abortion activist in the DA’s office, get[s] in the grand jury room and start[s] explaining all this to the grand jury, which is made up of your average Hillary voter, for all we know,” he said at the time. “And you start explaining what really went on here. Here we have this great organization, Planned Parenthood, that’s trying to plan families and trying to protect women from the terrible, almost fatal disease of pregnancy, and here come these rogue agents disguised as journalists, but they don’t have immunity, and they’re the ones who’ve engaged in criminal activity,” he said.

Newman said the 2013 case against Karpen needs also to be reviewed.

Karpen was accused by his former employees of intentionally killing babies who were born alive during late-term abortions at his Houston abortion facilities. There is reason to believe that photographic evidence showing two aborted newborns with large gashes in their throats was never submitted to the original grand jury for consideration, Newman noted.

During the murder investigation, Karpen was represented by one of Anderson’s closest family friends, Chip Lewis, who later publicly threatened to retaliate against Operation Rescue for making the evidence it uncovered public.

Shortly after Anderson’s grand jury “no-billed” Karpen, Lewis donated $25,000 to Anderson’s political campaign.

“Chip Lewis, Karpen’s attorney, falsely accused Operation Rescue of paying three former Karpen employees to testify against him and of ‘doctoring’ grisly photographs of babies Karpen had allegedly murdered, according to witnesses,” Operation Rescue said.

“Lewis threatened Operation Rescue after no true bill was returned against Karpen. Lewis told the Houston Chronicle, ‘Those responsible for bringing these wholly unfounded allegations against Dr. Karpen will be held responsible for their crimes.’ He further threatened an investigation of Operation Rescue, which never materialized.”

It is Lewis, Operation Rescue said, who “has tight connections to District Attorney Devon Anderson.”

“He is a long time personal friend of hers and her now deceased husband, former D.A. Mike Anderson, and is the largest political donor to the Anderson family. It could be assumed that Anderson owes Lewis for his friendship and political favors.”

Further, Planned Parenthood lawyer Josh Schaffer “stated that during the grand jury proceedings, he and prosecutors maintained a ‘dialogue … about the details of the case, and kept that going through,’” court records reveal.

“To further demonstrate collusion with the pro-abortion lawyers, an attorney for the National Abortion Foundation, Mr. Derek Foran, announced to the world via The New York Times that he had insider information and ‘learned about the indictments in Texas about a half hour before they were publicly announced,’” records state.

The submission also explains Anderson’s grand jury violates a variety of procedural rules, leaving the indictment invalid.

“It is well settled that no person may disclose the existence of an indictment as it is to be kept secret until the defendant is in custody or has been released on bond,” court filings explain. The grand jury also was without “proper authority,” so the charge “must be quashed,” the filing explains.

“Furthermore, the prosecutors have systematically leaked grand jury proceedings to unauthorized persons. There is no justifiable basis for this conduct and granting this motion to quash the indictments is the only appropriate remedy,” it said.

A spokesman in Anderson’s office told WND she was not taking questions on the issue, and a statement by Anderson said: “These matters will be thoroughly reviewed by a judge and jury. I am confident that the actions of the DA’s office in this case will withstand any scrutiny.”

In the first undercover video released by CMP, Deborah Nucatola of Planned Parenthood commented on crushing babies.

“We’ve been very good at getting heart, lung, liver, because we know that, so I’m not gonna crush that part, I’m gonna basically crush below, I’m gonna crush above, and I’m gonna see if I can get it all intact,” she said.
