Donald Trump won the state of Louisiana, but by delegate count, Sen. Ted Cruz matched him and soon may have more – and now the billionaire businessman is vowing to sue.

In a tweet, he wrote: “Just to show you how unfair Republican primary politics can be, I won the State of Louisiana and get less delegates than Cruz – Lawsuit coming.”

The ‘Stop Hillary’ campaign is on fire! Join the surging response to this theme: ‘Clinton for prosecution, not president’

Trump won the primary held in the state on March 5 with just over 41 percent. Cruz came in second with nearly 38 percent. But both took home the same 18 number of delegates.

How?

When Sen. Marco Rubio dropped out of the presidential race on March 5, he left five delegates in Louisiana on the table. These delegates are free agents, able to vote for whomever they please. And according to the Wall Street Journal, it’s widely believed these delegates will stand in the Cruz camp.

On top of that, Louisiana still has five delegates that are unbound – that don’t have to vote for any particular candidate based on vote count, but can rather select for themselves.

The Wall Street Journal, citing Louisiana Republican sources, reported these five are also more likely to go for Cruz, not Trump.

“That means Cruz, who officially lost the primary by 10,896 votes, could walk away with 10 more delegates than Trump,” WBRZ News reported.

The system of proportional delegate award was made long ago, way before Trump entered the political ring.

Jason Dore, executive director of the Louisiana GOP, told the Times-Picayune if Trump now has a problem with the delegate process, he should take it up with Rubio’s camp.

“[It’s] between Mr. Trump and those guys,” he said.

He also said the state GOP “will be prepared” if Trump does sue, but right now, it’s not even clear who would be named the defendant in such a challenge, New York Magazine reported.
