Court leaves state’s abortion industry on life support

A court ruling has left the Louisiana abortion industry on life support, with media expressing fears that the decision could close down all but one of the clinics there.

“Most Louisiana abortion clinics could close unless SCOTUS steps in,” lamented MSNBC.

And ABC News said, “Group: Ruling May Leave Louisiana With 1 Abortion Clinic.”

Operation Rescue, a pro-life advocate that among other projects maintains documentation regarding abortion clinics across America, confirmed that Louisiana abortionists are hurting.

It reported that as a result of the court decision this week, two abortion clinics, including the largest one in Louisiana, closed down.

Another closed last week.

The moves were the result of a ruling by the 5th U.S. Circuit Court of Appeals that a state law requiring abortionists to have local hospital admitting privileges to help patients who may suffer injury can be enforced while it is being challenged in court.

A Texas case addressing similar issues is before the U.S. Supreme Court.

OR reported Delta Clinic of Baton Rouge technically remains open but is referring women to Women’s Health Care Center in New Orleans because of the hospital requirement.

OR said it had filed previous complaints against Delta Clinic because of injuries patients suffered there.

“We couldn’t be happier that this incredibly dangerous ‘House of Horrors’ abortion business has stopped abortions and we pray that the Delta Clinic will soon shut down permanently,” said OR President Troy Newman.

“This proves that hospital privilege requirements protect women from victimization and injury by shoddy, incompetent providers that have run amok over women’s health for years without accountability,” he said.

OR reported Abortion Assistance in Bossier City also closed.

“A receptionist is telling callers that while no abortions are currently taking place, she expects an ‘appeal to the Supreme Court’ will allow the facility to resume abortions as early as next week,” OR said.

Earlier this month, the Causeway Medical Suite in Metairie closed and since then movers have been seen emptying the office, OR said.

The organization reported in 2010 that Louisiana had seven abortion facilities, and now just two remain, Women’s Health Care Center and Hope Medical Group in Shreveport.

ABC reported that, according to the Center for Reproductive Rights, which is representing the abortion businesses, only one clinic can remain open under the state law.

That’s Women’s Health Care Center in New Orleans, where doctors have admitting privileges.

Following the adoption of the law in Louisiana, the abortion clinics sued, and Judge John deGravelles said he would suspend the requirement.

The appellate court, however, overturned him, ruling that Louisiana “has made a strong case that it is likely to succeed on the merits.”

The panel noted that in its own previous rulings on the issue, it found that the abortion businesses “had not demonstrated that the law placed an undue burden on a large fraction of women.”

“The district court concluded that the act imposed an undue burden based on [his own] statistical analyses … [that concluded] the act will leave 99 percent of Louisiana women unable to get an abortion.”

But it continued: “We begin with the district court’s conclusion that the act deprives 99 percent of Louisiana women of access to an abortion. This calculation is misleading because it does not actually measure the effects of the act. According to the district court’s methodology 99 percent of Louisiana women had no access to an abortion before the act was passed and 99 percent of Louisiana women will have no access to an abortion after the act goes into effect.”

That, the court said, is an “absurd outcome.”

But the court said its decision was only regarding whether the law can be enforced during the overall appeals process and not on the merits.
