A Donald Trump voter in Texas was arrested on a charge of “electioneering” on Monday after showing up at the polls wearing a pro-Trump hat and a T-shirt bearing Hillary Clinton’s infamous comment about half of Trump supporters being “a basket of deplorables.”

Brett Mauthe, 55, was arrested in Bulverde, Texas after refusing a request from poll workers to turn his shirt inside out.

“He wanted to take a stand,” Bulverde Police Chief Gary Haecker told the New Braunfels Herald-Zeitung. “Unfortunately, he was arrested.”

Mauthe said he complied when asked to remove his hat, but refused to alter his shirt because he was not aware wearing clothing in support of a particular candidate violated election rules, reported KSAT-TV.

“I went up there and talked to him. I told him, ‘I support you and I appreciate what you’re doing. It’s your right, but you’re going about it the wrong way here.’ The election code has very specific rules,” Haecker told the newspaper. “These are the rules and you have to abide by the rules.”

Cynthia Jaqua, Comal County’s election coordinator, said arrests for electioneering almost never happen, but she stressed the rules do apply to voters as well as those who stand outside polling places holding campaign signs and encouraging people to mark ballots for a particular candidate.

“Electioneering is prohibited within a 100-foot marker,” Cynthia Jaqua told the TV station. “You cannot express views for or against a candidate or political party by wearing buttons, T-shirts, hats, whatever else or carrying signs,” she said.

Other voters also told the TV station they didn’t realize the rules about electioneering applied to voters.

“I don’t feel like you should be preaching to anybody, but I do feel like you should be able to wear a shirt if you want and if it has the candidate,” said voter Georgina Pereida.

Mauthe was in violation of section 61.003 of Texas’ election code, which prohibits “electioneering and loitering” within 100 feet of a polling place. He was charged with a misdemeanor and released the same day after posting a $700 bond, according to the newspaper. He faces a possible $500 fine.
