Former attorney general says Clinton has likely ‘disqualified herself’ from holding elected office

Michael Mukasey, who served as the nation’s attorney general from 2007 to 2009, said during recent interviews that a probe into Democratic presidential candidate Hillary Clinton’s State Department email scheming is justified. And the former AG predicts that the investigation will produce findings so damning that Clinton will be forced to withdraw from the presidential contest.

Appearing on “Fox News Sunday,” Mukasey assured his interviewers that an investigation of how Clinton handled email communications at the State Department is “not a political witch hunt” but necessary for security officials to better understand how the former top diplomat’s actions may have hurt national security.

“It is inconceivable to me that a great deal of that was not classified,” Mukasey said of the email communications. “The question is what she knew about what was on those emails.”

Mukasey said that he’s confident enough in the FBI’s “long history of impartial investigations” to be sure that Clinton isn’t being targeted politically.

He also called claims that investigators are more interested in Clinton’s private email network than potential wrongdoing on her part “ridiculous.”

“The FBI does not investigate machines; it investigates people,” he said. “She is certainly one of the people being investigated.”

As for how Clinton may have disqualified herself from being president of the United States, during an appearance on “Morning Joe” Mukasey pointed to Title 18, Section 2071 of the U.S. Code.

The statute provides:

Whoever willfully and unlawfully conceals, removes, mutilates, obliterates, or destroys, or attempts to do so, or, with intent to do so takes and carries away any record, proceeding, map, book, paper, document, or other thing, filed or deposited with any clerk or officer of any court of the United States, or in any public office, or with any judicial or public officer of the United States, shall be fined under this title or imprisoned not more than three years, or both.

And goes on to state:

Whoever, having the custody of any such record, proceeding, map, book, document, paper, or other thing, willfully and unlawfully conceals, removes, mutilates, obliterates, falsifies, or destroys the same, shall be fined under this title or imprisoned not more than three years, or both; and shall forfeit his office and be disqualified from holding any office under the United States. As used in this subsection, the term “office” does not include the office held by any person as a retired officer of the Armed Forces of the United States.

It may be time for Clinton to get out that cloth she was talking about last week to wipe Democrats’ tears.
