Paul moves to protect vets, seniors from massive government gun grab

Sen. Rand Paul (R-Ky.) has introduced legislation aimed at stopping the federal government from unilaterally stripping gun rights from thousands of seniors and veterans by declaring them “mentally defective” without proper medical review.

The Department of Veterans Affairs currently reports veterans who have a fiduciary trustee—someone who handles financial issues on their behalf— to the FBI’s National Instant Criminal Background Check system as “mentally defective,” making them ineligible for gun ownership.

So far, the VA has reportedly declared some 260,381 veterans who have fiduciary trustees to the background check system as “mentally defective.”

Earlier this year, the White House announced that it was working with the Social Security Administration to “begin the rulemaking process to include information in the background check system about beneficiaries who are prohibited from possessing a firearm for mental health reasons.” The move would expand the NCIS reporting to cover all of the nation’s seniors.

The Department of Health and Human Services has also moved to make it easier to report Americans to the FBI as mentally ill.

Paul says his Protecting Gun Rights and Due Process Act will stop the Obama administration’s quiet gun grab in its tracks by requiring SSA and VA to get a doctor’s opinion before reporting anyone to the FBI as unfit for gun ownership.

“I refuse to stand idly by while the Obama administration unilaterally strips away gun rights from our nation’s veterans and seniors. The Protecting Gun Rights and Due Process Act will provide necessary protection for gun-owning Americans, and ultimately ensure that the Second Amendment is not infringed upon,” Paul said.

In addition to requiring that seniors and vets are only reported to the NICS after proper medical review, Paul’s legislation would require the Attorney General to review the names reported to the FBI on a yearly basis to ensure that VA and SSA officials are in compliance with the legislation. Paul also wants the names already reported to the NICS by the VA and SSA reviewed.

The National Association for Gun Rights applauded Paul’s proposed legislation, saying it “will do much to block President Obama’s ability to strip the Second Amendment rights from law-abiding gun owners, veterans, and senior citizens without due process.”
