This Senate measure could create a hurdle for the EPA water bill

The Senate on Wednesday approved a bill that attempts to halt the Obama administration’s massive power grab over the nation’s small waterways. Unfortunately, Obama is expected to barrel forward with his power grab despite the effort.

Lawmakers, including three Democrats, passed the Congressional Review Act (CRA) resolution against the Environmental Protection Agency’s (EPA) water rule with a vote of 53-44. If the GOP backers of the bill were able to secure a veto-proof majority for the legislation, it would prevent Obama’s EPA from implementing its controversial new water rules.

Unfortunately for opponents of Obama’s new environmental legislation, that isn’t likely to happen.

Instead, Sen. Joni Ernst (R-Iowa), the resolution’s sponsor, says the bill will force the president to consider the rural small business owners and farmers who will be hurt the most by the new EPA rules.

“My legislation is the necessary next step in pushing back against this blatant power grab by the EPA,” Ernst said Wednesday from the Senate floor.

“We will send this to the president, where he will be forced to decide between the livelihood of our rural communities nationwide and his unchecked federal agency.”

The bill came as a response to the GOP’s failure to move forward legislation from Sen. John Barrasso (R-Wyo.) that would force the EPA to rewrite the water bill.

“Most Democrats chose an ideological power grab over sensible clean water rules yesterday,” Senate Majority Leader Mitch McConnell (R-Ky.) said following that measure’s defeat.

“This regulation feels a lot like the latest in a sustained Obama administration regulatory assault on their families,” he continued on Wednesday. “Well, the Senate is going to pursue another avenue today to protect the middle class from this unfair regulatory attack.”
