2 cops in Freddie Gray case sue Marilyn Mosby

Marilyn Mosby, the state’s attorney at the heart of the prosecution against Baltimore police tied to the arrest of Freddie Gray, the black suspect who died shortly after being taken into custody from complications of a spinal injury, is now being sued by two city officers.

Sgt. Alicia White and officer William Porter, two of the officers who face charges in the April 2015 death of Gray, filed a suit against Mosby and Maj. Sam Cogen of the Baltimore sheriff’s department for defamation and invasion of privacy, the Daily Caller News Foundation reported.

Basically, the officers are alleging Mosby and Cogen knew the charges they brought against arresting officers in the Gray case were bogus, but that they went ahead and filed them anyway. Why? To help stop the riots that tore through the city over the death of Gray, the officers alleged.

The attorney for White and Porter, Michael Glass, said he’s in process of expanding the charges to include “likely a count of malicious prosecution, false arrest, false imprisonment, violation of the Maryland declaration of rights, article 24 and 26,” and will have the amended paperwork prepared before the end of June.

“These six officers [arrested for Gray’s death] were essentially sacrificed,” he said, to the Daily Caller News Foundation. “Alicia White, she’s accused of murder. She never touched Mr. Gray.”

Officially, White and Porter were charged with manslaughter, assault, reckless endangerment and misconduct in office. Porter’s first court hearing ended in a mistrial and he faces another one before the end of the year.

But legal minds say a case against Mosby and Cogen won’t be easy to win, mostly because of the complexities of proving their case and because of the difficulties of successfully prosecuting sitting government officials.
