EPA Administrator Gina McCarthy told a sympathetic audience Thursday that the agency’s relationship with the states has never been better than it is right now, under her watch.
Speaking at an event sponsored by the left-leaning Center for American Progress, McCarthy said recent conflicts with states over the Obama administration’s “Water of the U.S.” rule, as well as nasty spills of the agency’s own making, conceal the fact that states and the EPA are getting along just fine.
“I think EPA has, frankly, never had a better relationship, and more open, with the states, and more respectful of one another,” she told the audience.
Thirteen states have sued the EPA over its implementation of the Waters of the United States rule, a reinterpretation of the Clean Water Act that — had a federal judge not enjoined its taking effect last week — would have allowed the agency to micromanage the smallest of waterways and private-property watersheds.
Following the court’s injunction, which blocked the EPA from acting on the rule, leaders in many of the other 37 states likely began to wish that their states, too, were parties to the suit.
That’s because the agency wasted no time in announcing that the injunction would not deter its administrators, with the Obama administration’s blessing, from plowing forward with the rule in every one of the states that wasn’t suing the EPA.
If you think about it, that says a lot about the style of leadership that radiates from the Obama administration: taking by force that which can be taken without resistance — even (and especially) from its allies.
